Mediation

MEDIATION IS AN
ART FORM

Now more than ever, Texas courts will order mediation before proceeding to trial.  The mediation process is confidential and involves a third party mediator working with the parties to facilitate a settlement.

 

Mediation, just like a trial, is an art form.  There are good mediators and bad mediators; and here is one place experience matters.  An experienced attorney will know when you need to find a way to say yes, or when you need to stand firm and go to trial.  A settlement isn’t always possible, but we will be here to work through any outcome that arises. The goal is always the same when The McClelland Law Firm is representing you…stand for what is right and work to deliver the best possible outcome for you, the client.

 

Things to know:

  • The mediator doesn’t offer legal advice, they facilitate communication.

  • The goal is to reach an agreement

  • If a mediated settlement agreement is made, it is binding and not revocable

  • You can settle some of the issues, and leave the rest for trial
